What you need to know
before you sell.

These are the NRI-specific legal requirements for a property sale in India. Our reports and services directly support each of these steps.

TDS Deduction (up to ~14.95%)

The buyer is legally required to withhold TDS on the full sale price — far more than the 1% a resident seller pays. We include a free capital gains & TDS estimate with your valuation report; your CA uses it to apply for a lower-deduction certificate.

Form 145 & 146

Your CA issues Form 146 (tax clearance certificate, replacing Form 15CB) based on our valuation report, then files Form 145 (replacing Form 15CA) on the IT portal — effective 1 Apr 2026. Both are required before repatriation of sale proceeds.

Power of Attorney

If you cannot travel, a limited POA allows a trusted person to sign the sale deed on your behalf. The POA must be notarized in your country and attested by the Indian consulate.

Repatriation Timeline

After sale registration and TDS filing, repatriation via your NRO account typically takes 4–8 weeks. A clean document history and timely valuation significantly speeds this up.
